All references to "the Site" refer to the internet sites run by The X777 Partnership. All references to "us" and "our" refer to The X777 Partnership.
The X777 Partnership accepts no responsibility for the accuracy, validity or otherwise of any advert displayed on the site.
Placing an Advertisement
Introduction
By submitting an advertisement
to our web site(s), you are deemed to have accepted the terms and conditions
laid out here. These terms and conditions and the contract of which they
form part shall be governed by English law. All references to "the Customer" refer to the user applying to place an advertisement for
an item on our web site(s).
This service offers the facility to compose and place an advertisement
for an item or items on our web site.
Processing your advert:
Only one item may be featured in each advertisement.
The advertisement copy, details and photograph(s) you supply must be legal, decent,
honest and truthful and must comply with the British code of Advertising. The advertisement must not:
- be false, inaccurate or misleading;
- be offensive or menacing, abusive, defamatory, or in breach of copyright, confidence, privacy or any other rights;
- infringe any third party's copyright, patent, trade mark, trade secret or other proprietary rights or rights of publicity or privacy;
- be fraudulent or involve the sale of counterfeit or stolen items;
- be in breach of any applicable laws or regulations (including, but not limited to, laws governing export control, consumer protection, unfair competition, anti-discrimination, false advertising);
- be obscene, indecent or contain pornography;
- be for anything other than a tangible asset. Services, schemes etc. are not allowed.
- create liability for us or cause us to lose (in whole or in part) the services of our ISPs or other suppliers;
- contain any computer viruses, macro viruses, trojan horses, worms or anything else designed to interfere with, interrupt or disrupt the normal operating procedures of a computer or to surreptitiously intercept, access without authority or expropriate any system, data or personal information;
- cause the Site to be interrupted, damaged, rendered less efficient or such that the effectiveness or functionality of the Site is in any way impaired.
The X777 Partnership is not able to verify the truthfulness of any statements (including the authenticity of photographs) made by a customer in the advertisement copy. Accordingly, the Customer shall be responsible for any losses, expenses or other costs incurred by The X777 Partnership caused by an untrue statement or inaccurate photograph supplied by the Customer.
In order to meet the technical and production requirements of the web site, The X777 Partnership reserves the right to edit, amend or alter the copy or photograph supplied by the Customer. Where possible - The X777 Partnership will contact the Customer to inform them of these changes prior to publication.
In the event that The X777 Partnership is unable to accept an advertisement for any reason, we will attempt to inform the Customer of this if at all possible. In the event that we reject the advertisement, no charge will be incurred by the Customer. No contract will be deemed to exist between the Customer and The X777 Partnership until the advertisement has been accepted for publication on the Site.
The copyright in all adverts (including text and photographs) shall be owned by us and you hereby assign all such copyright to us.
Fulfillment timing
All advertisements are immediately updated to the website. The
X777 Partnership reserves the right to extend all fulfillment deadlines
and can not be held responsible for any losses caused thereby.
Refund Policy - How to cancel an advert
In order to obtain a full refund on the cost of the advertisement - cancellations must be made in writing within 24 hours of being submitted. Cancellations made after the advertisement is live on the website will not be eligible for a refund. Advertisements can be cancelled by using the details on the website contact page and including your World Pay Transaction ID and the advert reference number or unique url.
How and when your order will be confirmed
Advertisements will be confirmed online by means of a link to the advertisement
on the final page of the advertising process and by the sending of an automated email.
In the event that an advertisement is rejected for inclusion, The X777
Partnership will send an email to the Customer explaining why it has been
rejected.
How you can change or delete your advertisement once live
Trade advertisers who have selected a multiple item advertising rate are able to update advertisement details via the trade interface without any further charge.
Single advertisements can be changed or deleted by following the instructions provided in the confirmatory email sent in response to each advertisement placed, or by using the website contact page, including your World Pay Transaction ID and the advert reference number or unique url. No charge is made for deletions or for changes made by the Customer themselves online. The X777 Partnership will, however, charge an additional fee of £10 + VAT for changes requested via email once the advertisement is live on the Site.
Liability
The X777 Partnership will
require to carry out routine maintenance and service of it's servers and
equipment. While The X777 Partnership seeks to keep disruption to a minimum,
it does not guarantee that the advertisement will be continuously available
on-line for the duration of the advert.
Where an advertisement does not appear on the Site despite confirmation
being sent to the advertiser, the Customer will be entitled to an additional
free week's inclusion or a refund of the advertisement price, unless the omission,
cancellation or mismatch was caused by unforeseen circumstances beyond
the reasonable control of The X777 Partnership or breach of contract by
the Customer. The X777 Partnership's liability for breach of contract
or negligence shall not exceed an amount equal to the price of the advertisement
or series of adverts involved.
English law shall govern the terms and conditions of this contract of
which they form a part.
